{"id":2814,"date":"2018-03-14T17:12:12","date_gmt":"2018-03-14T16:12:12","guid":{"rendered":"https:\/\/www.asd-int.com\/?p=2814"},"modified":"2020-06-03T14:18:26","modified_gmt":"2020-06-03T12:18:26","slug":"4-points-on-working-time-for-posted-workers","status":"publish","type":"post","link":"https:\/\/www.asd-int.com\/en\/4-points-on-working-time-for-posted-workers\/","title":{"rendered":"4 points on working time for posted workers"},"content":{"rendered":"<p style=\"text-align: left;\">Any foreign company deploying posted workers to France is required to respect French labour law, notably with respect to the payment of the French minimum wage and French working time.<\/p>\n<p style=\"text-align: left;\"><!--more--><br \/>\nIn response to the questions often asked by our clients, we have selected 4 salient points to remember concerning the rules on working time in France.<\/p>\n<h2 style=\"text-align: left;\">1. WORKING TIME IN FRANCE<\/h2>\n<p style=\"text-align: left;\">Maximum working time is 48\u00a0hours per week (from Monday 0\u00a0h\u00a000 to Sunday 24\u00a0h\u00a000) and 10\u00a0hours per day. There may, however, be certain exemptions.<\/p>\n<h2 style=\"text-align: left;\">2. WEEKLY REST PERIOD<\/h2>\n<p style=\"text-align: left;\">The employee must have at least 35\u00a0hours of rest per week. No employee may be compelled to work more than 6 days per week. A weekly rest period of at least 24 hours and a daily rest period of 11 hours are mandatory.<br \/>\nFailure to respect these provisions incurs penalties of up to 1\u00a0500\u00a0euros. (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006808248&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=\" target=\"_blank\" rel=\"noopener noreferrer\">art. R. 262-1 of the Labour Code<\/a>)<\/p>\n<h2 style=\"text-align: left;\">3. OVERTIME PAY FOR ADDITIONAL HOURS<\/h2>\n<p style=\"text-align: left;\">In the standard context, the legal working time is 35\u00a0hours per week. Hours worked over and above this legal working time are paid at overtime rates:<\/p>\n<ul style=\"text-align: left;\">\n<li>\u00a025% for 8\u00a0additional hours (36<sup>th<\/sup>\u00a0to 43<sup>rd<\/sup>\u00a0hour)<\/li>\n<li>\u00a050% from the 9<sup>th<\/sup>\u00a0hour (with effect from the 44<sup>th<\/sup>\u00a0hour)<\/li>\n<\/ul>\n<p style=\"text-align: left;\">Specific agreements exist and can replace the standard context.<\/p>\n<h2 style=\"text-align: left;\">4. PAID LEAVE<\/h2>\n<p style=\"text-align: left;\">The employee is entitled to 2.5 days of paid leave per month of effective work with the same employer.
