Below are the key points required for an understanding of the prior declaration of posting and how to obtain it.<\/p>\n<p><!--more--><\/p>\n<h2>1. THERE ARE 3 TYPES OF DECLARATION FORMS<\/h2>\n<ul>\n<li>\u00a0Provision of service or operation for own account: this method of posting relates to the employees who are posted by their usual employer to provide a service for his direct clients.<\/li>\n<li>\u00a0Intragroup mobility: this declaration concerns the workers posted by their usual employer who supply their services to the other companies of the group to which the employer belongs.<\/li>\n<li>\u00a0Supply of temporary workers by a temporary staff agency: prior declaration of posting for a foreign temporary staff agency. This method of posting relates to the posted employees in the context of a mission to a client of their employer.<\/li>\n<\/ul>\n<h2>\u00a02. PROCEDURE FOR ONLINE DECLARATION<\/h2>\n<p>The Ministry of Labour has created a single online portal which enables any company posting workers to France to complete the necessary formalities. You will need to create an account at the official website\u00a0<a href=\"https:\/\/www.sipsi.travail.gouv.fr\/auth\/login\" target=\"_blank\" rel=\"noopener noreferrer\">www.sipsi.travail.gouv.fr<\/a>\u00a0and follow the steps. (The website is available in French and English only).<\/p>\n<h2>3. OBLIGATION AND VALIDITY OF THE DECLARATION<\/h2>\n<p>With effect from 1<sup>st<\/sup>\u00a0October 2016, the prior declaration of posting is mandatory and must be completed exclusively online at the website\u00a0<a href=\"https:\/\/www.sipsi.travail.gouv.fr\/auth\/login\" target=\"_blank\" rel=\"noopener noreferrer\">www.sipsi.travail.gouv.fr<\/a>. The declaration is effective for the full duration of the\u00a0<strong>posting<\/strong>\u00a0(the maximum legal posting period is 24 months).<\/p>\n<h2>4. WHEN MUST IT BE SUBMITTED?<\/h2>\n<p>The declaration must be made before any service is supplied by a posted worker. Before each mission or provision of service in France, the declaration must be made at the Ministry of Labour website. In the event that any factors change during the posting, the declarant can amend his previous declaration and submit a new one. The old declaration is automatically archived in the government database and can be accessed by the Labour Inspectorate in the event of checks.<\/p>\n<h2>5. COMPLETING THE PRIOR DECLARATION OF POSTING<\/h2>\n<p>The prior posting form is divided into 6 sections. You will need to provide information concerning:<br \/>\n\u2022 data on the foreign company (contact details, registration number etc.)<br \/>\n\u2022 the employer (names of the directors, etc.)<br \/>\n\u2022 the representative in France responsible for liaising with the French authorities<br \/>\n\u2022 the principal or client (name, address, SIRET no. etc.)<br \/>\n\u2022 the mission or provision of service for which the workers are posted (places, dates, places of accommodation, etc.)<br \/>\n\u2022 the posted employees (name, address, salary, work schedule, etc.)<\/p>\n<h2>OFFICIAL TEXT<\/h2>\n<p>The Official Journal of the Republic of France\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do;jsessionid=62374FEAC833B11261B0DEB098FB25E6.tpdila14v_1?cidTexte=JORFTEXT000033691669&amp;dateTexte=&amp;oldAction=rechJO&amp;categorieLien=id&amp;idJO=JORFCONT000033691464\" target=\"_blank\" rel=\"noopener noreferrer\">published on 27<sup>th<\/sup>January 2016<\/a>\u00a0an order fixing the templates of the certificate of posting of drivers or seamen employed by transport companies. The order takes account of the amendments introduced by\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000032950925&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener noreferrer\">decree no. 2016-1044 of 29<sup>th<\/sup>\u00a0July 2016<\/a>\u00a0on the electronic submission of the declarations and certificates of posting of employees.<br \/>\nThe certificate of posting mentioned in\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000023086525&amp;idArticle=LEGIARTI000028996727&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener noreferrer\">article R. 1331-2 of the transport code<\/a>\u00a0is prepared in accordance with one of the templates registered by the Department of Legal and Administrative Information, under CERFA numbers 15552*02, 15553*02 and 15554*02 respectively.<br \/>\nThe certificate of posting is transmitted electronically using the \u201cSIPSI\u201d teleservice of the Ministry of Labour (sipsi.travail.gouv.fr). The order of 29<sup>th<\/sup>\u00a0June 2016 on the certificate of posting of drivers or seamen employed by transport companies is repealed.
