BTI and BOI:

Applications must be submitted prior to customs clearance, and BTIs or BCOs must be obtained before a customs dispute in order to be recognised and taken into account by the customs authorities.
It is therefore important to anticipate the analyses carried out by the customs services during inspections in order to avoid disputes, penalties and the possible blocking of imported goods in bonded warehouses.
Customs regulations, both in terms of taxation and trade liberalisation (production of specific documents, standardisation, prohibition, etc.), are based on the “country/product” pairing.
“Country” refers to the country of origin, not the country of provenance. The product is determined by a tariff classification.
Regulations vary according to these two factors; for example, the same product may be taxed differently depending on its country of origin.
It goes without saying that if one out of two pieces of information is incorrect, the importer is financially liable, and the consequences can be very serious.
Applications for BTI – Binding Tariff Information – and BOI – Binding Origin Information – must be submitted to the local customs authorities, but are managed by the national customs directorate of each country in conjunction with a specialised unit of the European Commission.
The rules of origin are complex. The BOI is strongly recommended when production takes place in several countries. In some cases, the origin goes back to the raw material; in textiles, for example, the origin of the yarn rather than the fabric is required for certain products. In other cases, it will be the percentage of production carried out in each country.
When goods are imported, if there is any doubt about either the origin or the tariff classification, the customs service will release the goods in order to analyse the accuracy of the data, which may result in the goods being held up in customs for several weeks while awaiting the results.
If it turns out that one of the two data items is incorrect, customs will re-establish the situation on the basis of the new data. An official report is then drawn up and the importer is given formal notice to pay the additional duties and taxes and/or to comply with the new requirements of customs legislation.
The BTI or BOI must be obtained before the goods pass through customs. In the event of doubt during a customs inspection, simply provide the BTI or BCR to avoid any disputes and release your goods.
The BTI and BOI are valid for 6 years and are recognised throughout the European Union, so you can import your goods with complete peace of mind via a port or airport as close as possible to your place of destination, and reduce your logistics costs (fiscal representation makes it easy to carry out these operations – contact us if necessary).
Obviously, there must be a direct link between the BTI and/or BOI. Requests are accompanied by technical data sheets and even samples if possible. An BTI and/or BOI can be used for several references if the variants do not affect the product itself.
For example: the same product in different colours, the product being the same, the BTI and/or BOI will be valid whatever the colour of the product.
