In response to the climate emergency and the massive degradation of forests around the world, the European Union will apply Regulation (EU) 2023/1115 from 30 December 2025 (30 June 2026 for SMEs and VSEs), prohibiting the placing on the market or export from the European market of products that have contributed to deforestation or forest degradation after 30 December 2020.
Which products are affected?
Commodities such as coffee, cocoa, rubber, palm oil, soya, beef and timber, as well as some of their derivatives (leather, printed paper, charcoal, etc.), will have to be subject to a declaration of due diligence (DDR).
What’s new for businesses :
- Obligation to prove that products are “zero deforestation” and comply with the legislation of the country of origin.
- Filing of a declaration of due diligence, including geolocation of production plots, full traceability of the supply chain and an official signature committing the operator to responsibility.
- The DDR number must be quoted when completing customs formalities.
Anticipate the consequences!
- Risk of refusal to market products deemed non-compliant.
- Increasingly complex supply chains.
- Need to review partnerships with suppliers to ensure environmental compliance.
How can we prepare for these changes?
- Implement an internal due diligence system that complies with Articles 8 to 11 of the EUDR.
- Identify and qualify the risks associated with geographical production zones.
- Collect the necessary data and documents from suppliers.
