On 14 September 2026, the European Commission adopted an update to the list of dual-use items subject to export controls1.

This development notably concerns certain semiconductor manufacturing equipment, advanced integrated circuits and industrial technologies. Exporting companies must check whether their products are affected in order to anticipate their regulatory obligations and secure their import-export customs formalities.

Which products are concerned?

European Regulation (EU) 2021/8212 governs the export of goods, software and technologies that may be used for both civilian and military purposes.

The 2026 update introduces new product categories and modifies certain technical specifications. Companies must therefore verify the classification of their goods and any required authorisations. To determine the tariff classification of their products, they can also find out about BTI (Binding Tariff Information), a procedure that is separate from dual-use goods controls.

❗ Warning:
Certain non-listed products may also be subject to controls depending on their destination, end-use or applicable restrictions

What are the obligations for exporters?

To secure their international operations, companies must:

  • verify the classification of their products against European regulations;
  • check the restrictions applicable to destination countries and end-users;
  • obtain the necessary authorisations before shipment;
  • ensure the traceability of operations and monitor regulatory developments.

Failure to comply with these obligations may result in the blocking of goods and administrative or criminal sanctions, depending on the applicable legislation.

To better manage their operations, companies can rely on specialised customs services.

Please note:
The update adopted by the Commission must follow the prescribed procedure before entering into force. It is therefore advisable to check its publication in the Official Journal of the European Union.
